The business competition has been evolved into the patent race completely.Our country has become a main battle field of patent race, and companies suffer from serious patent barriers. It is difficult to adjust the new situation of patent competition only by experience or a single patent design around. Therefore, it becomes a primary difficulty and task of patent design around how to combine innovative design method with overall process of patent design around. Based on the above problems, this proposal aims at the construction of systematic and scientific patent design around method. Firstly, based on the patent portfolio theory and patent analysis,the four-dimension primary and secondary dimension map is built to identify the patent portfolio, and the patent portfolio evaluation model is developed to research the front end of patent design around; Secondly, the constraint extraction strategy of TRIZ tool matching with the patent system at different stages is put forward and the reading diagram of patent information is established. To achieve efficiency extraction of patent information the high-low constraints evaluation model of patent is built which is based on the cutting function and fuzzy theory. Finally, based on TRIZ innovative tool, the problem mining of patent portfolio and design around path selection are achieved. The overall process of patent evasion innovation design method combining TRIZ theory with constraint breakthrough is built and organic integration of the whole process of innovative tool and design around is achieved.The systematic patent design around method is obtained in this proposal, which lays the theory and technology foundation for enterprise to break the patent barriers and protect core technology.
商业竞争已演变为赤裸裸的专利竞争,我国已成为专利竞争的主战场,面临严重的专利壁垒。单纯依靠经验或单一专利规避方式难以适应专利竞争的新形势,如何将创新设计方法融合于专利规避全过程之中成为专利规避的主要难点和任务。针对以上问题,本项目以构建“科学化系统化的专利规避设计创新方法”为目标。首先,基于专利组合理论与分析,建立产品四维主次维度图并识别专利组合,构建专利组合评估模型,实现对专利规避前端研究;其次,提出一种TRIZ工具与专利制度相匹配的约束提取方法,建立专利信息阅读图,基于功能剪裁与模糊理论建立专利的高低约束评估模型,实现专利信息的有效提取;最后,基于TRIZ创新工具实现专利组合问题挖掘与规避路径选择,建立融合TRIZ理论与约束突破的产品全流程专利规避创新设计方法,实现创新工具与规避设计全过程的有机融合。课题获得的系统化专利规避理论方法,为企业突破专利壁垒和保护核心技术奠定理论与技术基础。
