标准必要专利的形成机理及其FRAND许可定价研究

Along with the rapidly development of globalization and innovation, more and more patents have been merged into the standards. How to identify the Standards Essential Patents (SEPs) and how to determine their licensing royalties on Fair, Reasonable and Non-discrimination (FRAND) principles have becoming an important issue in the process of technology transfer, patents litigation and antitrust practice. Current researches have some shortcomings, such as the methods to identify the SEPs are unclear, the FRAND licensing principles are ambiguous and the approaches of pricing are rough. The study will analyze the formation process of SEPs and put forward a ‘Three-steps’ method to identify them. For the first time, taking the court’s judgment as research objects, Multi-case study is used to identify the main factors affecting the licensing process under FRAND. Then the study proposes principles and an analytical framework under the FRAND principles on the base of game theory. By building the model of Lorenz curve, the study calculates the SEPs’ contribution to the standard, and the value contribution of the SEPs is analyzed. On the base of above, we will bring out an improved Sharply method to determine the licensing royalty. This study will reveal the formation mechanism of SEPs and provide new methods for identifying the SEPs and for determining the SEPs’ licensing royalties under FRAND. The study will also provide effective tools for decision-making scientifically in the technology transfer, patents litigation and antitrust practice.

伴随着经济全球化与技术创新的快速发展，专利与标准日益融合。如何辨识标准必要专利以及如何公平、合理、无歧视地（Fair, Reasonable and Non-discrimination，FRAND）许可定价日益成为技术转移、专利诉讼以及反垄断实践中的重要问题，也已成为技术经济、知识产权、产业政策等领域中的科学前沿。针对当前标准必要专利识别不清、FRAND许可原则模糊、许可定价方法粗略等问题，本课题深入分析标准必要专利的形成路径，提出“三步分析”识别方法；首次以法庭判决书为研究对象，利用多案例研究提取FRAND许可主要影响因素；提出基于竞合博弈的定价原则和框架；建立洛伦兹曲线模型，分析标准必要专利的贡献，并提出改进的Sharply值许可定价方法。本研究将揭示标准必要专利形成机理，为其识别及FRAND许可定价提供新的方法，为技术转移、专利诉讼、反垄断实践中相关主体的科学决策提供有效工具。

研究标准必要专利的主要特征、形成机理、价值影响因素及其FRAND许可定价对于促进我国高技术企业开展核心技术创新、维护市场竞争秩序、平衡保护创新与维护社会公平具有重要意义，本研究聚焦了企业专利战略领域中的一个重要科学问题。项目首先基于知识图谱分析，识别了标准必要专利领域的研究前沿，从宏观上观察我国生产率的波动特征及其背后的影响因素，指出影响技术经济与产业发展的宏观因素，并分析了创新驱动的机遇与转型发展的条件；进而实证了标准必要专利在前向引用数、同族专利数、权利要求数、专利强度等指标上表现出明显的统计特征，在此基础上，提出了名义标准必要专利和真正标准必要专利的分类，并提出了真正标准必要专利识别的准则、方法和路径。其次，对FRAND准则进行具体化分析，基于多案例的分析，提取标准必要专利 FRAND 许可定价的主要影响因素，提出标准必要专利价值包括技术价值和战略价值，实证分析了标准必要专利价值的影响因素，提出了 FRAND 许可定价的原则和逻辑分析框架。第三，对比分析了不同的标准必要专利定价方法，针对当前Shapely值模型没有考虑到专利成本、风险或其他条件的差异性，提出了改进的Shapely模型，并利用算例实证了改进的Shapely模型的有效性。项目研究可以为企业标准必要专利战略的选择，标准必要专利领域行业规则以及国家标准必要专利知识产权政策的制定起到积极的参考作用。
